(五)参与各管制组织的会员国 参与四大出口管制组织之会员国整理於表二. 参,各国出口管制制度比较 一,美国之出口管制制度 (一)法律机制 美国出口管制制度之法源来自国会通过之出口管理法案(Export Administration Act, EAA),根据此法案美国商务部订定出口管理条例(Export Administration Regulations, EAR),此为美国出口管制制度之主要法规.此外,尚有其它与武器出口管制有关之法律,包括1976年制定之武器输出管制法(Arms Export Control Act, AECA)及1954年订定之原子能法案(Atomic Energy Act).原子能法案主要管制有关核子物质与技术之输出,而武器输出管制法乃针对可能直接导致他国军力增长,进而影响国际均势,有害美国安全的军用物资,装备和科技进行出口管制. 除了上述三项法源依据外,美国政府会视环境变动而订定新的法案来作为实施出口管制的依据.例如:1976年,美国为应付紧急需要,保障国家安全,特订定「国际危机经济势力法案」(International Emergency Economic Power Act of 1976),该法案赋予美国总统在美国面临危急情况下或受到非常威胁时,实施出口管制或贸易禁运等措施之权力. (二)管制政策形成之机制 英国之出口管制政策虽亦配合其国家安全,外交与经贸政策而调整,但因英国与美国在国际外交上步调一致,所以均是参照美国的管制政策,例如推动对伊拉克之禁运.
