苹果和三星专利权之争实质就是创新能力之间的较量。 苹果去年4月首先在美国起诉三星，作为回应，三星随后在韩国和其他国家向苹果发起诉讼。双方一时掀起了专利大战。近日，三星在美被陪审团裁定败诉，或将产生一笔巨额罚款。尽管三星被裁定赔偿苹果10 .5亿美元(约合人民币6 6 .75亿元)，但双方的专利案尚未算落幕- -苹果正拟定一份申请禁售的28款三星产品名单，经美国法院认可后，这些产品将被禁止在当地市场销售。其中中国涉及2款手机和1款平板电脑。不过按流程，苹果若也想在中国也禁售这些三星产品，还需向国内法院提起诉讼，并经历无法估算时长的诉讼过程。　　对此，苹果中国并未进行任何说明，但据记者了解，在美胜诉后的苹果已拒绝向三星提供授权。也就是说，除非三星在未来的产品中改掉一切可能被苹果起诉的细节，否则在美国诉讼案的示范作用下，任何形式任何地区的侵权诉讼，都可能出现。尽管苹果目前还未在中国国内对三星提起诉讼，故这些机型在国内的销售暂不会受影响，但据南都记者了解，苹果总部已决定不向三星提供与此次侵权案相关的专利授权。言下之意，即便三星愿意为每台售出的手机支付额外的专利费用，苹果也不会接受，多少有些“赶尽杀绝”之意。　　通信行业咨询机构战国策首席分析师杨群认为，有了美国侵权案审判结果做参考，苹果又坚持“不授权”，接下来很有可能是全球各地接二连三的诉讼官司。由于中国已跃居全球智能手机第一销售国，这场“战火”很有可能会延烧至国内。　　咨询调研公司RationalAB分析师张星亦认为，苹果有可能在中国对三星提起诉讼。但她同时表示，如果以禁售为目的意义并不大，“即便苹果在中国起诉三星，等真正有结果的时候，上述涉案机型早已退市。而从目前三星的产品线看，三星已悄然迈出了‘去iPhone造型"的路线，两大旗舰产品GALAXY SIII和GALAXY NOTE风格和iPhone完全不同。”但如果是为了赔偿和造势，则仍有“放手一诉”的价值。事实上，早在三星之前，苹果就曾经同样对在美国市场迅速崛起的HTC发动过专利攻势，结果HTC同样遭到了败诉，涉及侵权的产品也在美国市场遭到了禁售，受此影响，HTC在美国市场的表现日趋疲软，今年二季度开始更是重新把重心放回了亚洲市场。对此，HTC大中华区总裁任伟光曾经向南方日报记者直言，海外市场的开拓过程中，专利费用是一笔巨大的成本。　　其实就连同为美国公司的摩托罗拉，近年也曾经因为专利问题和苹果对簿公堂，所幸其十多年积累的专利池让其在和苹果的专利博弈中互有胜负。“这也是为什么谷歌愿意花125亿美元高价收购摩托罗拉移动的关键原因，至于其他一些新兴Android厂商，恐怕就没那么好运了。”张星称。
