Katy has been working from home as a bookkeeper for several years.She is unable to commit to working specified hours because she has young children.Before she had children she was employed by a firm of accountants on a full-time basis.This same firm now subcontracts small jobs to Katy and she does them as and when she can on a self-employed basis.She does no other paid work.
Katy records time spent on each client’s books and invoices the accountants for her hours worked at an agreed hourly rate.She is paid gross and attends to her own tax liabilities and pays Class 2 National Insurance contributions.
The firm has given Katy one of their PCs to do her work on and she also uses the accountants’ stationery with their logo on it.
Although Katy agreed to the above deal,with hindsight she is now thinking that she is still technically employed by the firm and it would have been in her best interest to be considered as employed rather than self-employed,as she would then have been entitled to holiday and sickness pay.
